Positive experience and outcome

We took over managing our elderly Aunts affairs, only to discover that, amongst the tangled web of many issues, her purchase of a Golden Charter Funeral Plan had unwittingly embroiled her in the McClure’s Family Protection Trust scandal. After seeking legal advice on the matter, we eventually made contact with Emma Blair, team leader of the private client department at Jones Whyte. Contrary to some online reports about the company, Emma was both polite and extremely helpful, offering a number of approaches to resolve the problem. Thankfully we had the resources to proceed with the winding up of the trust and we were assigned Nicholas Wright as our case officer, who handled the process from the outset to conclusion in an exemplary professional manner. Based on our experience, his communication skills, along with the due diligence he applied throughout, was faultless. Nicholas is a credit to both Jones Whyte and his profession.

Jan was awesome

Jan was awesome helping us secure a property. Having contacted us proactively after an introduction via an estate agent, Jan walked us through the conveyancing services and produced a clear cost estimate up front. We engaged Jan the next day and she guided us through bidding thoughtfully and successfully. Jan was always available and responsive. We had the property we wanted wrapped up three days after engaging with her. Excellent outcome and very satisfied with all aspects of the service.

Steer WELL clear of Jones Whyte

My aunt passed away in January 2023 and it wasn't until this month - November 2024 - that her final beneficiary received their bequest. My aunt's and her late husband's estate consisted of a house (in a trust so that both sets of relatives would benefit), an offshore savings bond, an insurance policy and accounts with two banks. You wouldn't have thought that there would be anything overly complicated in that, nevertheless it took them TWENTY-TWO months to process the estate, charging us over £22,000 for the privilige. Suffice to say, we are far from happy with Jones Whyte's performance. A trainee solicitor was appointed to take charge of the estate processing and I think that that is where much of the problem lies. I certainly don't want to put all the blame on her though, she was never anything less than polite and usually responded to my emails in one to three days, always trying to be helpful. However, surely a trainee needs supervision from a manager or another experienced member of staff and there was never any indication that this was the case. There also seemed to be no great urgency from them to try and get things processed as quickly as possible for us, instead appearing perfectly happy for the process to take as long as it takes and for the fees to mount up. The completion on the house sale took place in December 2023, but Jones Whyte didn't distribute the proceeds until mid-March. This was because, I was told, that it was neccessary to determine that no council tax was owed by my aunt's estate or the Trust. The process of determining this didn't commence until mid-January, after the Christmas and Hogmanay break. My aunt hadn't paid council tax since entering a care home in 2020 so the answer from the council was inevitable. They also had to determine whether the home insurance had been cancelled (it had). In the event, it was myself that contacted these third parties directly after no response was forthcoming from the third-parties to Jones Whyte's emails. Their policy was to just sit and wait for them to respond and leave it at that - no chasing-up. This resulted in the THREE MONTH delay. The banks paid out fairly quickly once Probate had been granted (Probate took three months, once again after being chased-up by myself) but the Insurance company took a lot longer with the savings bond. Once again though, Jones Whyte were content to wait it out and it was my phone calls that eventually got the insurance company moving and consequently, by last January, it seemed that all the remaining monies were ready to be paid out. However, it was then that the Jones Whyte accountant noticed that the savings bond was based in Ireland and so liable to Income Tax for the year in which my aunt died. Why wasn't this noticed much earlier in the process? Surely such a feature would have been noticed by an experienced solicitor had they actually looked at it. This is what makes me believe that the trainee wasn't being properly supervised. Unbelievably, it then took another seven months of Jones Whyte and their accountant communicating back and forth with HMRC to obtain the information required to determine how much tax was owed and then another couple of months to get clearance that all of the IHT had been paid. I do accept that not all of the delays were because of our trainee solicitor or her supervisors - assuming there actually were any - but the lack of urgency to chase things up with third parties certainly was. Mistakes such as the initial IHT forms being completed erroneously and, the aforementioned non-realisation of Income Tax being owed on the overseas savings bond just exacerbated the delays. The latter was intrumental in the beneficiaries having to wait an extra nine to ten months to receive their money. We didn't choose Jones Whyte to handle my aunt's estate. My aunt & her husband used McClure's to set up their trust and Jones Whyte took over when the former closed down. From our excruciatingly overlong experience with them, It ought to go without saying that I would most certainly not recommend using Jones Whyte.
